Abuse of a Position of Trust

When someone uses their authority, power, wealth, or status to influence, pressure, or control another person in ways the other person cannot safely resist.

This information is not legal advice – it is meant to signpost information only. Please seek a professional opinion before taking action.

Legal definition

UK law (Sexual Offences Act 2003) criminalises sexual activity where an adult abuses a position of trust over someone under 18. For adults, jurisprudence and safeguarding frameworks still recognise “positions of trust” as significant power imbalances relevant to consent and exploitation.

What it looks like in real life
  • A wealthy, powerful man controlling access to money, jobs, visas, or opportunity.

  • Staff feeling unable to refuse or report because of risk to employment or immigration status.

  • A person being treated as “replaceable” or afraid to speak out due to the abuser’s influence.
